1.1 Introduction

Before accessing or using our website, please review thoroughly these Terms of Service (“Terms of Service”, “Terms”), as they outline the respective rights, obligations and remedies. Among other things, they entail an agreement to arbitrate (unless you choose to opt-out). These terms encompass several key elements: a prohibition of class and representative actions and the provision of non-individualized relief for all claims and matters, whether in court or arbitration. They also outline various limitations and exclusions, establish a clause governing the jurisdiction, venue, and governing law of disputes (except where prohibited), and include obligations to comply with applicable laws and regulations.
This website is operated by Outland Adventure Vehicle Rentals. Outland Adventure Vehicle Rentals provides this website, along with all information, services and tools available from this site to you (the “user”). Your access and use of this site are contingent upon your acceptance of all the terms, conditions, policies, and notices detailed here. These Terms of Service apply to all users of the site, including, but not limited to, users who are browsers, customers, vendors, merchants, and/or content contributors.
By accessing or visiting any portion of our website and/or making any purchase, you engage in our “Service”
and agree to be bound by the following Terms of Service (“Terms of Service”, “Terms”) and accept all the terms, conditions, policies, notices and which are incorporated herein by reference.

If you do not agree with any of the Terms of Service outlined in this agreement, accessing the website or utilizing any services is not permitted.
Any new service, product, features or tools introduced to the existing store will also be subject to these Terms of Service.

1.2 Definition
The terms and their definitions listed throughout the site are provided below:

“Outland”, “we”, "us," and "our," refer to Outland Adventure Vehicle Rentals doing business as Outland.

“Guest”, “Client,” and "Customer" refer the party or parties executing the Rental Agreement for the rental of the Vehicle or the Equipment. It encompasses any individual, corporation, partnership, or other legal entity entering into this agreement for the purpose of renting the specified Vehicle or Equipment. Additionally, the Guest, as defined herein, shall also be considered a user of Outland's website https://www.outlandvancouver.com/, for the purpose of accessing rental services and related functionalities.

“Vehicle” refers to the motor vehicle rented by the Guest from Outland, as outlined in the Rental Agreement. This encompasses all tires, tools, keys, key fobs, licensed plates, roof-top tents, accessories, documents, and other products or items of property provided by Outland with the motor vehicle.

“Equipment” refers to the equipment (other than the Vehicle) the Guest may rent from Outland, as described in the Rental Agreement.

“Rental Agreement” refers to the agreements between the Guest and Outland governing the Vehicle and/or Equipment rental. This includes the rental document the Guest receives upon accessing the Vehicle and/or the Equipment, these Terms of Service (explicitly integrated by reference therein), the Departure Form, the Return Form, the Release of Liability, Waiver of Claims and Assumption of Risks and all other invoices, documents and policies (whether electronic or otherwise) sent to the Guest regarding the rental of the Vehicle.

“Departure Form” refers to the inspection report summarizing the condition of the Vehicle and/or Equipment which is to be jointly completed by the Guest and Outland at Pick-Up (as defined herein).

“Return Form” refers to the inspection report summarizing the condition of the Vehicle and/or Equipment which is to be jointly completed by the Guest and Outland once the Guest returns the vehicle, (as defined herein).

“Security Deposit” refers to the refundable sum collected upfront from the Guest to cover potential damages or expenses incurred during the rental period in accordance with the the Rental Agreement and outlined in Section – Damage and Security Deposits

“Pick up” refers to the point at which the Guest takes possession of the Vehicle and Equipment from Outland, in accordance with the the Rental Agreement and outlined in Section – Pick-Up

“Drop Off” refers to the point at which the Guest returns the Vehicle and Equipment to Outland, in accordance with the Rental Agreement and outlined in Section – Drop-Off

“Rental Fee” refers to the amount charged to the Guest for the rental service, as specified in the rental agreement.
2. General Terms
By agreeing to these Terms of Service, you confirm that you have reached the age of majority in your state or province of residence. Alternatively, if you are not of the age of majority, you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site. Any offer for any product or service made on this website is void or not legally enforceable where prohibited.
We are not liable if the information provided on this site is inaccurate, incomplete, or not up-to-date. The content on this website is intended for general informational purposes only and should not be solely relied upon for decision-making without consulting primary, more accurate, more comprehensive or more timely sources of information. This includes certain historical information this site may contain which necessarily, is not current and is provided for your reference only. Any reliance on information provided on the website does so at your own risk. We reserve the right but have no obligations to update any content on our site at any time. We may also introduce enhancements through our website in the future (such as new services and/or features including the release of new tools and resources) which will be governed by the existing Terms of Service. We have made every effort to accurately represent the colors and images of our products displayed on our website however we cannot guarantee that the color displayed on your device's screen will precisely match the actual product color. We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations. Outland reserves the right in its sole discretion but is not obligated to limit the use of the Services, features of the Services or sales of our products or Services for any reason or no reason and may exercise this right on a case-by-case basis.
If, at our request, you send certain specific submissions (for example contest entries) or if you willingly provide original concepts, suggestions, proposals, plans, or other content, whether online, by email, by postal mail, or any other means (collectively referred to as "comments"), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us. We are not obligated to maintain the confidentiality of any comments; to pay compensation for any comments; or to respond to any comments. We reserve the right, without obligation, to monitor, edit, or remove content that, in our sole discretion, we deem unlawful, offensive, threatening, libellous, defamatory, pornographic, obscene, or otherwise objectionable, or that violates any party's intellectual property rights or our Terms of Service.
You consent not to replicate, duplicate, copy, sell, resell, or exploit any part of the Service, its usage, or access, including any contact details on the website facilitating the service, without our explicit written permission.
To protect Outland, this rental agreement will be binding on the Guest, as well as on their respective heirs, guardians, successors, and authorized assigns.t its sole discretion, refuse to rent the Vehicle to the Guest. Outland reserves the right, at its discretion, to decline renting the Vehicle or Equipment to any Guest if Outland has concerns about their intended use or their ability to operate the Vehicle or Equipment.
Upon Pick-Up, the Guest shall be provided with a Departure Form, which must be duly completed and signed by the Guest. This Departure Form serves as a vital document outlining various aspects of the rental agreement and the condition of the rented vehicle.
The Departure Form shall include: (i) Date and Time of Pick-Up: The Guest must verify and confirm the date and time of pick-up as specified in the Rental Agreement. (ii) Information about the Reservation Holder: The Departure Form requires the primary driver's information, including their name, contact details, and driver's license number. Additionally, it may include information about the reservation holder, if different from the primary driver. (iv) Preexisting Damage Report: The Departure Form shall outline any preexisting damages or defects on the vehicle. The Guest must meticulously inspect the vehicle alongside an Outland representative and duly note any preexisting damages or issues to prevent disputes upon return. (v) Fuel Level: The Departure Form shall indicate the fuel level in eighths of a tank (e.g., 8/8 meaning full tank) to accurately record the initial fuel status of the vehicle. (vi) Vehicle Information: The Departure Form shall include details about the vehicle rented, such as make, model, color, and license plate number, ensuring clarity and accuracy.
The Guest must thoroughly review and accurately complete the Departure Form during the Pick-Up process. By affixing their signature to the Departure Form, the Guest acknowledges the accuracy of the information provided and the condition of the vehicle at the time of Pick-Up. Any discrepancies or omissions in the Departure Form may impact the Guest's liability for damages upon return of the Vehicle.
It is expressly understood that any damages or issues not documented in the Departure Form may result in the Guest being charged for said damages upon return of the Vehicle. Therefore, it is imperative for the Guest to conduct a comprehensive inspection of the vehicle and accurately report any preexisting damages or issues during the Pick-Up process. Failure to document damages or issues at the time of Pick-Up may render the Guest liable for any subsequent damages identified upon return.
To facilitate airport pick-up requested by the Guest, the Guest is required to provide Outland with their flight number. This enables Outland to monitor the flight status and coordinate a smooth pick-up efficiently.
3. Eligibility, Registration, User Verification
Only Verified Drivers who are at least twenty-one (21) years of age are permitted to operate the vehicle.
Where permitted, Outland has the right, but not the obligation, to undertake screenings, checks, and engage in processes designed to help verify the identities or check the users of the Services, including driving history and driver’s license validity.
Ten (10) days prior to the scheduled Pick-Up date, the Guest will receive a third-party secure link via email from Outland to verify their identity. It is mandatory for the Guest to complete this identity verification process no later than forty-eight (48) hours before the scheduled Pick-Up date and time.
If Outland is unable to verify the Guest and/or any Verified Drivers (for Rental Vehicles), Outland may cancel the reservation and forfeiture of any amounts already paid.
A Guest may request to become a/or add additional Verified Drivers to the booking of a Vehicle up to seventy-two (72) hours before the scheduled Pick-Up date and time and must notify Outland to allows us to coordinate the sending of a secure link for the identity verification process to those drivers at no extra charge. If a user is not the Guest who made the booking but elects to become and enter or complete the process to become a Verified Driver, in doing so such user also agrees to these Terms in their entirety. The term “Verified Driver” means Outland has completed a minimal level of review of the user as a driver. It does not mean a comprehensive investigation into such Verified Driver, and does not include any commitment to review motor vehicle driving history or criminal background checks. The reservation holder is ultimately responsible for all behavior of any Verified Drivers. Only Verified Drivers are eligible for the benefits offered under any protection packages, bundles, or excess coverages offered by Outland.
A Verified Driver is defined as the Guest and any additional person(s) present at the time of rental Pick up who: (i) Hold a current, valid (non-temporary) form of government identification with an image of your face. If you hold a non-Canadian form of government identification, you will be required to provide your passport; (ii) meet the Minimum Age; (iii) consent to identify verification and other background checks we may require. (iv) consent to and will provide other additional information we request for verification purposes when you attempt to rent our Vehicle; (v) have no major violations in the past three years (major violations are defined by state law and may include driving with a suspended or expired license, providing false or counterfeit documents) or alcohol/drug-related incidents in the past seven years, and have no more than two violations or accidents combined in the past three years; (vi) provide a valid and current physical street address and (vii) have a major credit card in their own name, and meet our other qualifications.
Outland may in its sole discretion use third-party services to attempt to verify the information you provide to us and to obtain additional related information and corrections where applicable, and you hereby authorize Outland to request, receive, use, and store such information.
The Vehicle must not be operated by anyone who has fraudulently obtained the rental by providing a fictitious name, false address, invalid driver’s license, or credit card; anyone whose driver’s license becomes invalid; anyone who has acquired the keys without authorization; or anyone who misrepresents or withholds information during the booking process or rental. Please note that all forms of required identification must include a name and address that match those on the Guest's driver's license.
Outland reserves the right to deny service to any individual for any reason, at any time.
4. Rental Terms
During the time frame indicated on the Rental Agreement (the "Rental Term"), the Guest consents to rent the Vehicle and Equipment from Outland. The Guest hereby recognizes that the Vehicle and Equipment rental is only a transfer of possession and not ownership.
For utilizing the Vehicle or Equipment throughout the Rental Term, the Outland will apply a rental fee (referred to as the "Rental Fee") to the Guest, calculated on a daily basis as specified in the Rental Agreement. The minimum rental duration is two (2) days.
By using our services, you consent to provide us with up-to-date, comprehensive, and precise purchase and account details for all transactions conducted. You also agree to promptly update your account and other information, such as your email address and credit card information, including expiration dates, to ensure your transaction completion and to enable us to contact you when necessary.
We maintain the right to reject any order that is placed with us. We have the discretion to limit or cancel the quantities bought per individual, household, or per order. These limitations might encompass orders made under the same customer account, utilizing the same credit card, or sharing the same billing and/or shipping address. Should we alter or cancel an order, we will attempt to inform you by reaching out to the email and/or billing address/phone number provided at the time the order was made. We also reserve the right to restrict or forbid orders that, in our judgment, seem to be placed by dealers, resellers, or distributors.
In the event of any loss or damage to the vehicle, or any personal property that occurs during the rental due to any cause regardless of fault, including collision, rollover, theft, vandalism, seizure, fire, flood, wind, hail or other acts of nature or God, Guest is responsible and is required to pay up to the deductible outlined in the insurance of the Vehicle. It is the Guest’s responsibility to report all the abovementioned to Outland and the Police immediately. Failure to report and document an incident within 24 hours may void insurance protection and the Guest will be responsible for the cost of all repairs.
4.1 Bookings and Booking Modifications
The Guests have the option to book a rental vehicle directly with Outland by following the link provided on our website for which, this Terms and Service shall apply. Alternatively, guests may choose to book our vehicle through third-party platforms such as Outdoorsy, RVezy, and Turo. However, the Guests opting for third-party bookings must adhere to our Terms and Services in addition to the respective Terms of those platforms. Outland is not responsible for any terms, conditions, or policies set forth by these third-party platforms. You acknowledge that your content (excluding credit card details) may be transmitted unencrypted and may involve transmissions over various networks and/or adaptations to conform to technical requirements of connecting networks or devices. Nevertheless, credit card data is always encrypted during transfer across networks.
Outland may permit or refuse your request a booking in its sole and absolute discretion.
Adventure essential plan
Bookings under the Adventure Essential Plan are non-refundable, and dates cannot be changed after purchase.
Adventure Plus plan
If a cancellation is requested by the Guest more than ten (10) calendar days prior to Pick-Up date: The Guest may receive a full refund. The Guest is permitted to modify their booking up to ten (10) days before the Pick up date, subject to Vehicle availability for the new desired dates. If the requested Vehicle is unavailable, the booking will be cancelled, and the Guest will be refunded the full Rental Fee. If there has been an increase in rates since the original booking date, the new rates will be applied to the modified booking. Outland reserves the discretion to decline the honour of promotional codes or other discounts used upon the original booking. In such instances, the Guest will be required to pay the price difference. If the Guest declines, the booking could be cancelled and the above mentioned Terms regarding refunds in this section will apply.
If a cancellation is requested by the Guest between 10 days and 72 hours before the pick-up date: The guest will receive a travel credit equivalent to the full value of the booking.
It is the Guest's responsibility to review our website for details on our services and what is included in the rental. Guests agree to pay the associated delivery fees for vehicle delivery outside the free delivery area: Metro Vancouver in British Columbia, Canada. Delivery fees for areas outside the free delivery zone must be calculated by Outland on an individual basis, as they vary depending on the guest's requested location.
Outland suggests that guests contact us before booking their trip to confirm delivery fees for vehicles delivered and/or picked up outside the free delivery area. We will be happy to provide this information, ensuring guests receive a complete quote that includes both the rental price and delivery costs before finalizing their booking. If a Guest has arranged for the Vehicle to be delivered outside the free delivery area and later wants to modify or cancel the delivery, Outland reserves the right to withhold any costs already incurred for arranging the delivery. Our standard Terms for booking modifications and cancellations will apply to the remainder of the booking fee refund. If a Guest wishes to change the Vehicle delivery or pick-up location to an area outside the free delivery zone after booking, they agree to cover the additional delivery fee. Outland reserves the right to refuse delivery/pick-up to the new location outside the free area. In such cases, the Vehicle must be picked up by the Guest within the free delivery area. If the Guest prefers to be refunded, the above-mentioned booking modification Terms will apply.
If a modification is requested by the Guest less than ten (10) calendar days before the Pick-Up date and Outland is unable to accommodate such a request, the Security Deposit (if already charged to the Guest’s credit card) will be refunded. However, Outland reserves the right not to refund the Rental Fee paid under this Rental Agreement. Please note that bookings are non-transferable.
4.2 Damage and Security Deposits
Prior to the beginning of the rental period, the Guest must provide Outland with valid credit card information, which will serve as the basis for a refundable security deposit pre-authorization (referred to as the "Security Deposit"). The Security Deposits for both Vehicles and Equipment will amount to one thousand five hundred dollars ($1,500) each. For additional Equipment requested upon booking, the specific Security Deposit will be outlined in the Rental Agreement and be equivalent to the replacement cost of such Equipment. After the Drop-Off of the Vehicle, the Security Deposit pre-authorization will be released within forty-eight hours via the same method of payment used for the security deposit, minus any deductions. These deductions include, but are not limited to, parking violations, traffic violations, toll charges, damages to or loss of the Vehicle, or any other charges incurred under the terms of the Rental Agreement and as further outlined in the Terms and Conditions. The Guest authorizes Outland to use the credit card used for the rental to cover any and all deductions aforementioned.
If the Vehicle or Equipment is damaged in any manner during the Rental Term, Outland may, at its sole discretion: (i) make a claim against its insurance policies; in such case, the Guest will be liable for paying all costs and expenses incurred by Outland that are not covered by Outland's insurance carrier (including, but not limited to, the full amount of any insurance deductibles); or (ii) charge the Guest the full cost necessary to repair or replace the damage, in addition to any other costs, loss, or expenses that Outland may incur as a result of such damage. This amount will become due and payable by the Guest upon Outland's request.
The Guest hereby authorizes Outland to first deduct from the Security Deposit pre-authorization any amounts owing under this Section by charging the credit card provided by the Guest and thereafter to take all steps or actions and pursue all claims and remedies against the Guest or its insurance carrier, if applicable, as may be legally available to Outland to recover any excess amounts owing by the Guest hereunder.
4.2.1 Pets
Pets are allowed in the Vehicle only with prior approval from Outland, and a maximum of two (2) dogs per vehicle is permitted. When in the Vehicle, pets must stay in the back seat where Outland will provide a seat cover. Pets are not allowed in the tent. Outland reserves the right to charge the guest a cleaning fee up to one hundred fifty dollars ($150) at its sole discretion, in addition to any other cleaning fees outlined in the Terms, for any excessive soiling of the Vehicle or the Equipment caused by a pet. The Guest is also liable for any damages caused by their pets to the Vehicle or the Equipment, including scratches. Outland may deduct any such fees from the Security Deposit.
4.2.2 Smoking
The Guest acknowledges that using tobacco products inside the vehicle or equipment, such as cigarettes, cigars, pipes, e-cigarettes, vaping, or cannabis products, is strictly prohibited. If the Vehicle or Equipment is returned and it odours or is soiled by smoke or vapour, we will collect an extra five hundred dollars ($500) cleaning cost from the Damage Deposit.
4.3 Rental Fees, Payment and Taxes
The Guest must pay Outland the entire Rental Fee at the time of Vehicle Reservation in order to validate the reservation, through our third party as outlined in our Privacy Policy.
The security deposit for the rental must be paid by the guest to Outland starting from ten (10) calendar days in advance up to, and no later than forty-eight (48) hours before pick-up. For the Equipment, the Guest shall pay Outland the entire Rental Fee at the time of the Equipment booking.
All payments owed under the Terms of the Rental Agreement must be made by the Guest using a major credit card (Visa, Mastercard, or American Express) or any other payment method that Outland’s third party may agree upon, such as Paypal. The Guest is responsible for paying all applicable taxes, including, but not limited to, Federal Good & Services Tax (GST), Provincial Sales Tax (PST) and Provincial Rental Vehicle Tax, in addition to any amounts owed under the Terms of the Rental Agreement.
Based on exchange rates in effect at the time of booking, all amounts are quoted in and must be paid in Canadian dollars. Any payment by the Guest using a non-Canadian credit card may be subject to exchange rates and currency conversion fees, as charged by applicable financial intermediaries, the payment of which shall be the sole responsibility of the Guest.
4.4 Key Exchange (Pick-Up and Drop-Off), Representations and Warranties
The Guest agrees to pick up and return the Vehicle at the mutually agreed upon date and time as coordinated with Outland. If the Guest fails to be present at the designated location at the agreed upon date and time for either the Pick-Up or Drop-Off, a fee of two hundred dollars ($200) will be charged for each occurrence. This fee is non-negotiable and will be applied automatically.
By agreeing to these terms, the Guest acknowledges and accepts responsibility for adhering to the scheduled times. In the event of any changes or delays, the Guest must promptly communicate with Outland to reschedule and avoid incurring additional fees.
4.4.1 Pick up
The Vehicle and the Equipment should be picked up by the Guest at the time and location provided in the Rental Agreement (between 8am PST until 7PM PST) unless otherwise specified at least 48 hours before the start of the Rental (the “Pick-Up”). Upon Pick-Up, the Guest recognizes and consents that the Vehicle and the Equipment are provided in good operational and roadworthy condition, free from any damage or defects (mechanical or otherwise) except those documented in the Departure Form.
Upon pick-up, the Guest must provide Outland with an authentic, current driver's license and the credit card used for booking, which must match the name on the driver's license of the primary driver. Outland will keep a copy of this license in compliance with our Privacy Policy and as specified in the “Eligibility” section of these Terms. It is a prerequisite for each rental, solely for the benefit of Outland, that Outland must be able to verify, to its sole satisfaction, that each Guest’s license has been legitimately issued to the Guest and is in good standing (not suspended, revoked, or otherwise restricted in any way).
If the Guest's driving history is not Outland's sole satisfaction, Outland reserves the right to deny the Vehicle Rental and end the Rental Agreement. If Outland determines that there are any deficiencies with the Guest’s license or driving history, including with respect to authenticity, validity or good standing, it may, at its sole discretion, refuse to rent the Vehicle to the Guest. Outland reserves the right, at its discretion, to decline renting the Vehicle or Equipment to any Guest if Outland has concerns about their intended use or their ability to operate the Vehicle or Equipment.

By affixing their signature to the Departure Form, the Guest acknowledges the accuracy of the information provided and the condition of the vehicle at the time of Pick-Up. Any discrepancies or omissions in the Departure Form may impact the Guest's liability for damages upon return of the Vehicle.
It is expressly understood that any damages or issues not documented in the Departure Form may result in the Guest being charged for said damages upon return of the Vehicle. Therefore, it is imperative for the Guest to conduct a comprehensive inspection of the vehicle and accurately report any preexisting damages or issues during the Pick-Up process. Failure to document damages or issues at the time of Pick-Up may render the Guest liable for any subsequent damages identified upon return.
To facilitate airport pick-up requested by the Guest, the Guest is required to provide Outland with their flight number. This enables Outland to monitor the flight status and coordinate a smooth pick-up efficiently.
4.4.2 Drop-Off
The Vehicle and the Equipment should be returned by the Guest at the time and location provided in the Rental Agreement (between 8am PST until 7PM PST), unless otherwise specified at least 48 hours before the end of the Rental (the “Drop-Off”).
Because the Vehicle and the Equipment requires cleaning and preparation for its subsequent rental, a late fee of one hundred fifty dollars ($150) may be automatically deducted from the Guest's deposit if the Vehicle and/or the Equipment is not returned on the specified time. If the Vehicle and/or the Equipment is returned two (2) hours beyond the specified time in the Rental Agreement or more, Outland reserves the right, in its sole discretion, to charge the Guest a late fee of up to five hundred hundred dollars ($500). Outland is not obligated to refund any portion of the Rental Fee if the Vehicle and/or Equipment is returned early.
The Guest is responsible for refilling or topping up the Vehicle's tank within a ten (10) kilometre radius of the Drop-Off location in accordance with the fuel type and fuel grade as specified in the Rental Agreement. Failure to do so will result in the Guest reimbursing Outland for all fuel costs incurred plus an additional ten percent (10%) surcharge. If the Guest returns the Vehicle without refilling the tank, a charge of one hundred fifty dollars ($150) will be automatically billed to the Guest, deducted from the damage deposit, irrespective of the fuel level.
Upon return of the Vehicle, the Guest shall complete and sign a Return Form, documenting the condition of the Vehicle and the Equipment at the conclusion of the rental period. The Return Form serves as a critical document to assess any damages or issues incurred during the rental period.
The Return Form shall include: (i) Date and Time of Return: The Guest must verify and confirm the date and time of return as specified in the Rental Agreement. (ii) Condition of the Vehicle: The Return Form shall include a section to document any new damages or defects incurred during the rental period, beyond those documented in the Departure Form. The Guest must carefully inspect the Vehicle alongside an Outland representative and accurately report any damages or issues. (iii) Fuel Level: The Return Form shall indicate the fuel level of the Vehicle upon return, ensuring it matches the level indicated in the Departure Form. Any discrepancies in fuel level may result in additional charges. (iv) Equipment Inventory: If applicable, the Return Form shall include an inventory of any Equipment rented alongside the Vehicle, ensuring all items are returned in good condition.
Completion and submission of the Return Form do not guarantee an automatic refund of the Security Deposit. The refund of the Security Deposit is subject to a final inspection of the Vehicle and associated Equipment by Outland, typically conducted within 48 hours of the Vehicle's return. During this final inspection, Outland will assess the condition of the Vehicle and Equipment, taking into account any damages or issues documented in both the Departure Form and the Return Form.
The Guest acknowledges and agrees that any discrepancies between the condition of the Vehicle and/or the Equipment documented in the Departure Form and the condition upon return may impact the refund of the Security Deposit. Outland reserves the right to withhold all or a portion of the Security Deposit to cover any damages, repairs, or additional charges incurred during the rental period.
If the Guest requests an airport Drop-Off, they must allow sufficient time for Outland to coordinate the Drop-Off. Outland will not be held responsible for missed flights due to insufficient time allotted by the Guest. It is the Guest's responsibility to ensure that adequate time is scheduled for Drop-Off to avoid any delays.
4.5 Pre and Post-Trip Inspection
Upon Drop off, the Guest must return the Vehicle and Equipment to Outland in the same condition consistent with the state it was received at Pick-Up, allowing for normal wear and tear. Outland reserves the right, in its sole discretion, to charge the Guest a cleaning fee of one hundred fifty dollars ($150) from the Security Deposit, or an amount determined by the cleaning expenses incurred by Outland, whichever is greater, if stains, dirt, odours, or any soiling resulting from the Guest's use cannot be removed through Outland's routine cleaning procedures.
The Guest hereby authorizes Outland to deduct the amount of any broken vehicle part or missing equipment from the Damage Deposit by charging such amounts to the credit card provided by the Guest and will pay any amounts in excess of the Damage Deposit to Outland on its demand.
5. Vehicle & Equipment Use and Restrictions
The Guest certifies and warrants to Outland that they are at least twenty-one years of age (21), have the legal right to drive in British Columbia, are a competent driver with a valid driver's license, and have enough experience to operate the Vehicle in any terrain over which the Guest may elect to drive it.
The Guest agrees at all time during the Rental Term that the Vehicle will not be driven, operated, or used:
(i) By anyone other than each Verified Drivers who have signed the Rental Agreement; (ii) By anyone whose driving ability is impaired in any manner whatsoever, including by alcohol, sleep deprivation, narcotics, intoxicants, or drugs, used with or without a prescription (refusal to perform any lawfully requested test of impairment will be deemed proof of such impairment for the purposes of this Rental Agreement); (iii) To carry more people than the number of seatbelts provided in the Vehicle; (iv) In an abusive, reckless, or wanton manner, or in any manner that a reasonable person would determine to be unsafe for the conditions in which the Vehicle is being operated; (v) In violation of any law, including but not limited to the Motor Vehicle Act (British Columbia), the Criminal Code (Canada), and any equivalent legislation of another jurisdiction to which the Guest and Vehicle may be subject; (vi) For transporting persons for hire, for business purposes, or in any manner which may be interpreted as a commercial operation; (vii) If the Guest suspects, or reasonably should suspect, that the continued use of the Vehicle would cause it damage; (viii) In violation of any terms of this Rental Agreement.
Although our Vehicles are designed to travel on unpaved roads, they are not intended for extreme off-roading. Specifically with respect to terrain, the Guest agrees that during the Rental Term, the Vehicle will not be driven, operated, or used: (ix) Other than on paved roads or reasonably appropriate dirt, gravel, or surfaces sufficient for the safe and legal passage of the Vehicle. Outland makes no representations or warranties that the Vehicle is appropriate for any particular conditions or circumstances; (x) In any stream, creek, river, lake, ocean, sea, or other body of water that is deeper than the radius of the wheel of the Vehicle. (xi) In any extremely steep inclines, rocky cliffs, deep mud, hazardous trails, deviating from designated roads even for a short distance and driving on private property without prior authorization from the owner. (xii) outside the United States and Canada, including a strict prohibition against taking any Vehicle into Mexico.
Forest service roads vary in condition depending on their designated use and maintenance, with some being well-graded and gravel-covered while others resemble off-road trails. The Guest bears full responsibility for any damages, towing charges, and additional expenses resulting from operating the Vehicle in restricted or unsuitable areas. Additionally, Outland may immediately terminate, without any further notice, the Guest’s right to use Vehicle under this Rental Agreement in the event of any breach of a breach of any of the representations, warranties, or covenants of this section and Outland will retain any other rights and remedies provided by law. In the event of such termination, each Guest will be jointly and severally liable to Outland for all damages, losses, penalties, fines, forfeitures, liens, and recovery and storage costs, including all related attorneys' fees, legal expenses, fees, and costs that the Outland may incur as a result of any such breach.
The Guest is responsible for paying attention to any warning lights on the dash and must take the appropriate action and contact Outland when necessary. The Guest is accountable for maintaining fluid levels throughout the rental period.
The Guest agrees not to exceed the vehicle’s Gross Vehicle Weight Rating and to refrain from altering or tampering with the vehicle or any of its accessories.
The Guest agrees that during the Rental Term the Equipment will only be operated by each Guest who has executed the Rental Agreement. The Guest represents and warrants to Outland that he or she is at least twenty one years of age (21), and has sufficient knowledge, training and experience to safely and legally operate the Equipment. The Guest covenants to inspect and examine the Equipment prior to use and use his or her own knowledge, training and experience to determine that the Equipment may be safely used for its intended purpose before using it or letting any other person use the Equipment. The Guest will ensure at all times during the Rental Term that the Equipment will not be operated or used: (i) by anyone other than each Guest specifically named as a party to the Rental Agreement; (ii) in any manner or for any purposes other than in accordance with the Manufacturer’s instructions and the intended uses the Equipment was designed for; (iii) in an abusive, reckless or wanton manner or in any manner that a reasonable person would determine to be unsafe for the intended use of the Equipment; (iv) if the Equipment is damaged or defective; (v) in violation of any law including, but not limited to, the Criminal Code (Canada) and any equivalent legislation of another jurisdiction to which the Guest and Equipment may be subject; (vi) for business purposes or in any manner which may be interpreted as a commercial operation; or (vii) in violation of any terms of this Rental Agreement. Outland may immediately terminate the Guest’s rental of the Equipment under this Rental Agreement in the event of a breach of any of the representations, warranties or covenants of this section. In the event of such termination, each Guest will be jointly and severally liable to Outland for all damages, losses, penalties, fines, forfeitures, liens and recovery and storage costs, including all related attorneys' fees, legal expenses, fees and costs that Outland may incur as a result of any such breach.
Outland reserves the right, at its sole discretion and without prior notice to the Guest, to repossess the Vehicle or Equipment at any time for reasons including, but not limited to, the termination of this Rental Agreement by Outland or the perceived abandonment of the Vehicle or Equipment. If Outland chooses to exercise its repossession right, it may undertake any reasonable actions to regain possession of the Vehicle. This may include remotely disabling the engine, remotely locking the doors, and tracking the Vehicle's location through GPS tracking systems or similar devices.
If the Vehicle or Equipment is repossessed, the Guest acknowledges and agrees to compensate Outland for all actual and reasonable expenses incurred by Outland in relation to the repossession. The Guest further agrees that such expenses may be deducted from the Damage Deposit by charging the credit card provided by the Guest for renting the Vehicle or Equipment. Any amounts exceeding the Damage Deposit shall be paid by Outland to Outland upon its request.
Outland has the right to seize vehicles without legal process or notice to the Guest. The Guest hereby waives all claims for damages connected with such seizure and shall pay all expenses incurred by the rental company in returning vehicle to Outland’s location. If the Guest continues to operate the vehicle after the right to do so is terminated, Outland has the right to notify RCMP the vehicle has been stolen. The Guest, Verified Drivers and passengers hereby release and discharge Outland from and indemnify, defend, and hold Outland harmless against any liability arising from such notice. Renter’s failure to return the rental vehicle as specified on the Rental Agreement or neglects to properly obtain an extension of the rental period from Outland may result in the vehicle being reported stolen, possibly subjecting renter and any other driver to arrest and civil and/or criminal penalties.
Throughout the rental period, the Guest agrees to retain possession of the Vehicle and all keys (or key fobs) provided by Outland, unless legally required otherwise, refraining from entrusting the Vehicle to any third party. When not in operation, the Guest commits to securely lock the Vehicle along with its contents and external accessories, and remove the keys (or key fobs) therefrom. Any loss of keys (or key fobs) provided by Outland to the Guest will incur an additional fee of $300.00 per set, which Outland reserves the right to deduct from the Damage Deposit by charging the Guest's provided credit card.
Outland disclaims liability for any theft, loss, or damage to personal belongings or property left in, upon, or carried within the rental Vehicle. any property of the Guest or third parties that may be left in, upon or carried within the Vehicle. The Guest will be responsible to Outland for claims by any third parties for loss or damage caused by the Guest’s property.
5.1 Tolls, Fines, Citations, Costs and Administrative Fees
The Guest must promptly report to Outland and is responsible for paying or reimbursing Outland for all fines, citations, penalties, tolls, violations or infractions, whether traffic, parking or otherwise. This also includes covering any court costs, towing expenses, storage liens, or associated charges resulting from the rental of the Vehicle under this Rental Agreement. Outland reserves the right, in its sole discretion, to pay all tickets, citations, fines, penalties, tolls, levies and interest on the Guest’s behalf directly to the appropriate authority, in which case the Guest will thereafter reimburse Outland for all amounts paid to such authority, or their designated agents, together with an administrative fee of fifty dollars ($50) and any legal fees and expenses incurred by Outland in connection with the matter. The Guest hereby authorizes the Outland to deduct the amount of any such fines, penalties, interest, and court costs for parking, traffic, toll and other violations from the Damage Deposit. These amounts will be charged to the credit card provided by the guest. Any remaining balance exceeding the Damage Deposit must be paid to Outland upon its request. The Guest agrees and acknowledge that Outland will, to the fullest extent required, cooperate with all federal, provincial, municipal and local officials charged with enforcing infractions and will provide to such authorities any information relating to the Guest, the Vehicle or this Rental Agreement as may reasonably be requested, subject to applicable laws.
5.2 GPS Tracking System
The Guest acknowledges that the Vehicle is equipped with GPS tracking technology and/or other similar communication devices. The Guest hereby grants Outland authorization to utilize any such device with which the Vehicle may be equipped or connected: (i) for tracking or locating a Vehicle that may be overdue for Drop-Off, reported stolen, suspected of being lost, stolen, abandoned, or in need of roadside assistance; (ii) as required or requested by law enforcement; (iii) if Outland reasonably believes there is an emergency posing a threat to the safety of the Guest or another person; or (iv) as necessary to defend, protect, or enforce Outland’s rights under this Rental Agreement. The Guest hereby waives, to the fullest extent permitted by law, any rights of privacy or confidentiality regarding the places where the Vehicle may be driven while rented to the Guest.
5.3 Problems on the Vehicle
If you encounter any mechanical issues, please contact Outland immediately. We are committed to provide you with the best support possible to resolve the issue and get you back on the road quickly and safely.
Guests are strictly prohibited from attempting to repair the Vehicle themselves. Any interference with the Vehicle's mechanical components by the Guest may result in the Guest being held responsible for any resulting mechanical failures or additional damages. Outland reserves the right to charge the Guest for any repair costs arising from unauthorized attempts to fix the Vehicle.
6. Insurance, Indemnification and Liability
Outland being based in British Columbia (as determined by Canadian law), protection package coverage is provided by the Insurance Corporation of British Columbia (“ICBC”), and Outland’s vehicles are insured by ICBC. The Guest must promptly report any damage to Outland or loss to the Vehicle or Equipment when it occurs, and in any event, no later than 24 hours after the occurrence of such damage or loss. The Guest will also assist and cooperate with Outland with any subsequent investigation, including any police investigation and handling of such incident or any liability claim against the Guest or Outland resulting from any such accident or situation of theft, loss, vandalism or other event causing loss or damage. The Guest will be accountable for the entire deductible in the event of an at-fault accident or any other incident.
The Guest represents and warrants to Outland that any motor vehicle insurance that it may obtain by or through a credit or debit card may not be valid for the rental of the Vehicle, therefore, the Guest is not depending on or relying on any such insurance coverage.
The Guest may purchase additional insurance coverage from any third party agency or provider at their sole discretion. In the event that the Guest’s obligations regarding damage or loss hereunder is covered by any insurance or benefits offered to the Guest by a third party, the Guest authorizes Outland to contact such third party provider directly on the Guest’s behalf and the Guest assigns all such benefits directly to Outland to recover all consequential and incidental damages, such as but not limited to the repairs of the Vehicle, incidental loss and other costs and expenses outlined in Section – Damages & Damage Deposit.

The Guest acknowledges that the aforementioned insurance coverage obtained by Outland is mandatory, non-negotiable and cannot be waived in connection for the rental of the Vehicle. Despite the insurance coverage provided, the Guest acknowledges and agrees that they will remain liable for any loss of or damage to the Vehicle during the rental term. Each Guest will be jointly and severally liable, will fully indemnify Outland pay for all costs, expenses, liabilities or lost profits arising out of, in connection with, or as a result of, any loss of or damage to the Vehicle or Equipment during the rental period, regardless of cause and however incurred.
Such loss or damage may include, but is not limited to: (i) damage to the glass, tires, bumpers, roof or roof-top tent, doors, undercarriage, accessories or interior of the Vehicle; (ii) theft, break-in or loss of the Vehicle or vandalism thereto as a result of the negligence of the Guest; (iii) loss of any equipment, accessories, documents or other property of Outland that was provided with the Vehicle; (iv) loss of use of the Vehicle by Outland; or (v) damage, destruction or loss of use of the Equipment by Outland, but shall not include any prior existing damage that is expressly noted on the Inspection Report. The Guest will maintain the Vehicle and Equipment during the Rental Term. Outland Adventure Vehicle Rental the foregoing, the Guest acknowledges that other than in respect to matters of minor or routine maintenance that a reasonable person may be expected to perform, it is not authorized to repair or have the Vehicle or Equipment repaired without the express prior consent of Outland. If the Guest repairs or has the Vehicle or Equipment repaired without the consent of Outland, the Guest will be liable to Outland for the estimated cost to restore the Vehicle and the Equipment to the condition it was in prior to the rental.
In compliance with industry standards and as further detailed in the copy of the insurance policies included within the vehicle, Outland ensures that the rented Vehicle is covered with a Third Party Liability insurance up to $2 000 000, Comprehensive and Collision Insurance, Comprehensive and Collision included, Deductible: Basic ($1000), Premium ($300) as provided by the Insurance Corporation of British Columbia ("ICBC"), in addition to Comprehensive Damage and Collision insurance. In connection with Outland’s obligations to its insurer, the Guest authorizes Outland to provide a copy of each License to ICBC together with all such other personal information relating to the Guest as the ICBC may require. It is the responsibility of the guest to have their own travel (health) insurance.
The Guest hereby waives any claim against Outland for incidental, special, or consequential damages in connection with the rental of the vehicle, equipment, or otherwise under this Rental Agreement, and agrees to absolve Outland, its Owners, and Employees from any liability or personal injury issues arising from the rental Vehicle and its use and operation.
The Guest acknowledges that, in connection with the rental of the Vehicle or Equipment, they are willingly engaging in an outdoor activity that involves a high risk of serious injury, dangers and hazards for which severe bodily injury, illness or death may result. The Guest acknowledges that even though the Vehicle and Equipment may have safety and protection features or purposes, injury, illness, death or property damage may still occur despite the correct and intended use of the Vehicle or Equipment.
The Guest represents and warrants to Outland that they possess sufficient skill, knowledge and training to engage in such outdoor activity safely and legally. In this regard, the Guest is solely relying on their own experience and expertise and not that of Outland, including, but not limited to the inspection, condition, or suitability of the Vehicle or Equipment for any specific use. The Guest hereby assumes all associated risks and hereby release Outland, its subsidiaries, parent companies and affiliates, and each of their respective current, former or future directors, officers, employees, contractors, agents, representatives, instructors, shareholders, successors and assigns from any and all liability, claims and causes of action arising from, as a result of, or in connection with the use and operation of the Vehicle or the Equipment due to any cause whatsoever, including without limitation, negligence (including negligence of Outland or any other Release or user of the Vehicle or Equipment), the failure of the Vehicle or Equipment, the insufficiency of the Vehicle or Equipment for any particular use or circumstance, breach of contract, or breach of any statutory or other duty of care owing under occupiers liability legislation or otherwise.
Before pick-up, it is a prerequisite for this Rental Agreement, solely for the benefit of Outland, that the Guest execute and provide to Outland a full waiver and release of liability in such form as deemed acceptable by Outland.
Our unwillingness or delay to exercise or enforce any right or provision of these Terms of Service does not imply a waiver of such right or provision. Outland's choice to partially or fully waive any right does not hinder its ability to utilize that right in the future, nor does it impede its exercise of any other rights outlined in this Rental Agreement. Furthermore, any waiver by Outland regarding a breach of any provision of this Rental Agreement is only valid if it is documented in writing. Unless explicitly stated in writing and, unless otherwise provided in such written waiver, it is restricted to the specific breach that was waived. These Terms of Service, along with any policies or operational guidelines we publish on this site or related to the Service, constitute the complete agreement between you and us, governing your use of the Service. They substitute any previous or existing agreements, communications, and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service). Any uncertainties in interpreting these Terms of Service shall not be construed against the drafting party.
In any manner arising from this Rental Agreement or from the use of the Vehicle or Equipment by the Guest or any other person, including claims of, or liabilities to, third parties, the Guest shall defend, indemnify, and hold Outland and its directors, officers, employees, or consultants harmless from and against any losses, liabilities, damages, injuries, claims, demands, awards, costs, attorney fees, and other expenses incurred by Outland or its directors, officers, employees, or consultants. For such events or losses, the Guest may file a claim to its third-party insurance provider, if any; but, in any case, for any such losses, the Guest will ultimately be responsible to Outland.
Outland has the authority to transfer all or some of its rights under this Rental Agreement to another party. The Guest cannot transfer or delegate any of its rights or duties under this Rental Agreement to anyone else without obtaining the prior written approval of Outland.
The rights, remedies, powers, and privileges granted to Outland under this agreement are cumulative. They are supplementary to, rather than exclusive of, any other rights, remedies, powers, and privileges that may be available to Outland under the law.
We cannot warrant, represent, or guarantee that your utilization of our service will be uninterrupted, timely, secure, or devoid of errors. Neither can we guarantee that the outcomes obtained from using the service will be accurate or reliable. You acknowledge that occasionally, we may remove the service for indefinite periods of time or terminate the service at any time, without prior notice to you. The Service, along with all products and services provided to you through the Service (unless explicitly stated otherwise by us), are offered "as is" and "as available" for your utilization. This means they are provided without any representation, warranties, or conditions of any kind, whether express or implied. These include all implied warranties or conditions such as merchantability, quality, fitness for a particular purpose, durability, title, and non-infringement.
In no case shall Outland, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.
7. Cancellation, No Shows, Refunds
Adventure Essential
Trips booked under the Adventure Essential Plan are non-refundable, and date changes are not permitted after the booking is confirmed and the guest is not eligible to receive a travel credit
Adventure Plus
If cancelled by the Guest more than ten (10) calendar days prior to Pick-Up date: The Guest will receive a full refund of the booking that was paid to confirm the reservation.
Outland will not be required to refund any booking amounts paid under this Rental Agreement if the Guest cancels a reservation on less than ten (10) calendar days notice before the Pick-Up date.
If cancelled between 10 days and 72 hours before the pick-up date the guest is eligible to receive a travel credit equivalent to the full value of the booking.
If cancelled by the Guest 10 days or less prior to the Pick-Up date: Outland will refund the Security Deposit if already taken from the Guest’s credit card but will not be required to refund the Rental Fee so paid under this Rental Agreement including cancellation during the orientation as well as during the test drive on the day of Pick-Up.
If the Guest fails to Pick-Up the Vehicle or Equipment without prior notice or cancels the reservation after the scheduled Pick-Up time, they will be considered a no-show. In such cases, the full rental amount will apply, and no refund or travel credit will be issued.
Outland may, for valid business reasons, including, but not limited to, the unavailability of vehicles or equipment, cancel the reservation by a Guest of a Vehicle or Equipment at any time before the Guest taking possession of the Vehicle or Equipment, in which case Outland will refund the Guest for all amounts paid under this Rental Agreement. In the event of any cancellation, Outland will not be responsible for, and the Guest will not hold Outland liable for, any damages, loss, costs or expenses that the Guest may incur as a result of the cancellation.
Outland is not responsible for, and the Guest will not hold Outland liable for, any loss on refunds that the Guest may incur as a result of any exchange rate fluctuations between the time of payment and the time of such refund or for any financial institution processing fees.

Redemption Process

To redeem a gift card, customers must enter the unique code provided on the gift card or in the purchaser's confirmation email when completing the booking on the Outland Adventure Vehicle Rentals website.

The gift card amount will automatically be deducted from the total price of the booking.

Combining Gift Cards with Promo Codes

Gift cards may be used in conjunction with promo codes.

Promo codes are applied to the subtotal (before taxes), and the gift card amount is then deducted from the final total (after tax).

Expiration of Gift Cards

Gift cards are valid for 24 months from the date of purchase.

Expiration occurs on the last day of the month in which the 24-month period ends. For example, a gift card purchased in December 2024 will expire on December 31, 2026.

Refunds and Transfers

Gift cards are non-refundable and cannot be exchanged for cash or any other form of monetary value.

Gift cards are transferable, and ownership can be transferred to another individual if necessary.

Gift cards may not be resold, transferred for value, or used for unauthorized commercial purposes.

Lost or Stolen Gift Cards

If a gift card or its code is lost or stolen, the purchaser must contact Outland Adventure Vehicle Rentals and provide proof of purchase.

Upon verification, Outland will assist in retrieving or reissuing the gift card.

Partial Use of Gift Cards

If the value of the rental is less than the total amount on the gift card, the remaining balance will remain on the gift card for future use.

A confirmation email will be sent to the customer with details of the remaining balance.

Using Multiple Gift Cards

Customers are permitted to combine multiple gift cards toward a single booking.

Checking Gift Card Balance

To check the balance of a gift card, customers must email the gift card number to Outland Adventure Vehicle Rentals. The balance will be provided via email.

Cancellations
-
Trips paid for with a gift card are subject to the same cancellation policies as all other bookings with Outland Adventure Vehicle Rentals.

If a trip is canceled, any amounts paid using a gift card will be refunded back to the gift card. The expiration date of the gift card will remain unchanged.

Security Deposit

A security deposit is still required when booking a trip with a gift card.

Customers must provide a credit card for the security deposit to cover potential incidents, such as late returns, damages, or missing items.

The deposit will be authorized 48 hours before the trip starts, and a secure link will be sent to the customer 10 days prior to the trip to submit their card details.

Bookings Beyond Gift Card Expiration

Travel dates may be scheduled for after the expiration date of the gift card, provided the booking and payment are completed before the card expires.

If a trip scheduled beyond the expiration date is canceled, any amounts paid will not be refunded to the gift card.

Currency

Gift cards are issued in Canadian Dollars (CAD) and can only be redeemed for products and services priced in CAD.

Geographical Limitations

Gift cards are only redeemable for bookings that originate from our Vancouver location and are subject to the same geographical limitations as the vehicle rentals.

Modifications to Terms

Outland Adventure Vehicle Rentals reserves the right to update or modify these terms and conditions at any time without prior notice.

We may provide you with access to third-party tools through our website or as part of our service; these tools are not under our supervision, control, or influence. You understand and accept that we offer access to these tools "as is" and "as available," without any type of endorsement and free from any warranties, representations, or conditions of any kind. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools. You use any optional tools that are made available to you through our website or service at your own risk and discretion and you should ensure that you are familiar and approve to the Terms on which these tools are provided by the relevant third-party provider(s).
Third-party materials may be included in some of the goods, services, and information that is made available through our service. Third-party links on this site may direct you to websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy of these websites, and we do not warrant and will not have any liability or responsibility for any third-party materials or websites, or for any other materials, products, or services from third parties.
We hold no liability for any harm or damages related to the purchase or utilization of goods, services, resources, content, or any other transactions conducted with third-party websites. Please carefully review the third party’s policies and practices and ensure you understand them before engaging in any transaction. Any complaints, claims, concerns, or inquiries regarding third-party products should be directed to the respective third party.
You agree to indemnify, defend, and hold harmless Outland, along with our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees, from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third party.
10. Prohibited activities
By agreeing to these terms, you acknowledge that your comments must not violate any right of any third party, including copyright, trademark, privacy, personality or other personal or proprietary right. Additionally, you agree that your comments will not contain any libellous or otherwise unlawful, abusive or obscene material, nor contain any computer viruses or malware that could affect the operation of the Service or any associated website. You are prohibited from using a fake email address, impersonating another individual, or misleading us or third parties regarding the origin of any comments. You are solely responsible for any comments you make and their accuracy. We take no responsibility and assume no liability for any comments posted by you or any third party.
Each provision within this Rental Agreement is distinct and severable and a declaration of invalidity or unenforceability of any such provision or part thereof by a court of competent jurisdiction shall not affect the validity or enforceability of any other provision hereof. The parties waive any provision of laws that might make any provision of this Rental Agreement invalid or unenforceable, to the extent allowed by applicable law. In addition to other prohibitions as set forth in the Terms of Service, you are prohibited from using the site or its content: (i) for any unlawful purpose; (ii) to solicit others to perform or participate in any unlawful acts; (iii) to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances; (iv) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (v) to harass, stalk, abuse, insult, harm, defame, slander, disparage, intimidate any user or discriminate based on the way they look, who they love, what they believe, how they self-identify, where they are from, or when they were born, including different treatment based upon legally protected classes. Discrimination of any kind is not tolerated by Outland. (vi) to submit false or misleading information; (vii) to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Service or of any related website, other websites, or the Internet; (viii) to collect, track or store any personally identifiable information about any other user; (viii) to spam, phish, pharm, pretext, spider, crawl, or scrape; (ix) for any obscene or immoral purpose; or (x) to interfere with or circumvent the security features of the Service or any related website, other websites, or the Internet. We reserve the right to terminate your use of the Service or any related website for violating any of the prohibited uses. (xi) sue or assert legal claims against Outland or an Outland user in any manner prohibited or waived by these Terms. (xii) use the Services for your own unrelated purposes, including to: (a) Commercialize any content found on the Services or software associated with the Services, including reviews Harvest or otherwise collect information about users without their and our consent (b) Recruit or otherwise solicit any user to join third-party services or websites or services that are competitive to Outland, without our prior written approval. Aside from the restrictions outlined in the Terms of Service, you are also forbidden to interfere with the operation of the Services, including by: (i) Using the Services in connection with the distribution or posting of unsolicited commercial messages (e.g., spam) Distributing viruses or any other technologies such as cancel bots, Trojan horses, harmful code, flood pings, denial- of-service attacks, backdoors, packet or IP spoofing, forged routing or e-mail address information, or similar methods or technology that may disrupt or interfere with the operation or provision of the Services, or harm Outland or the interests or property of others. (ii) Bypassing robot exclusion headers, interfering with the working of the Services. (iii) Systematically retrieving data or other content from the Services to create or compile, directly or indirectly, a collection, compilation, database, directory, or the like, whether by manual methods, or through the use of bots, crawlers, spiders, or otherwise. (iv) Using, displaying, mirroring, or framing the Services or any individual element within the Services, the Outland name, any Outland trademark, logo, or other proprietary information, or the layout and design of any page or form contained on a page in the Services, without the express written consent of Outland. (v) Accessing, tampering with, or using non-public areas of the Services, our computer systems, or the technical delivery systems of our service providers. (vi) Attempting to probe, scan, or test the vulnerability of any of our system or network or breach any security or authentication measures. (vii) Avoiding, bypassing, removing, deactivating, impairing, descrambling, or otherwise circumventing any technological measure implemented by Outland or any of our service providers or any other third party (including another user) to protect the Services. (viii) Forging any TCP/IP packet header or any part of the header information in any email or newsgroup posting, or in any way using the Services to send altered, deceptive, or false source-identifying information (ix) Attempting to decipher, decompile, disassemble, or reverse engineer any of the software used to provide the Services.
The obligations and liabilities of the parties that arose before the termination date will remain in effect even after the termination of this agreement, without exception.
These Terms of Service remain effective unless and until terminated by either party. You have the option to terminate these Terms of Service at any time by informing us of your decision to discontinue using our Services or when you stop using our site.
If in our sole judgment, you fail, or if we suspect that you have failed, to comply with any term or provision of these Terms of Service, we reserve the right to terminate this agreement at any time without prior notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

Outland reserves the right, at its sole discretion, to update, amend, alter, modify, or change any part of these Terms of Service, by posting changes to our website at www.outlandvancouver.com. It is your responsibility to periodically check our website for updates. We will also update the “Last update” date at the top of these Terms. Your continued use of or access to our website or the Service after any changes are posted constitutes acceptance of those changes. These changes will apply to all rentals starting after the date of posting, regardless of the terms at the time of reserving the Vehicle, without any further notice to the Guest.
Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice. We shall not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the Service.
12. Governing Law
These Terms of Service, this Rental Agreement, and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein. They shall be interpreted and enforced in accordance with these laws, without reference to applicable conflict of laws rules or principles.
13. Translations
In the event that Outland has given you a translation of the English language version of these Terms or any Policies, the English language wording will take precedence over any variations in wording between the English and other versions of the Terms and any Policies.
14. Mobile Terms of Service

The Outland Adventure Vehicle Rentals mobile message service (the "Service") is operated by Outland Adventure Vehicle Rentals (“Outland Adventure Vehicle Rentals”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.
By consenting to Outland Adventure Vehicle Rentals’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Outland Adventure Vehicle Rentals through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. The service will include promotional messages such as promotions, specials, coupons, and other marketing offers; it will also include transactional messages such as order updates and account alerts.
You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Outland Adventure Vehicle Rentals. Your participation in this program is completely voluntary.
We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.
You may opt-out of the Service at any time. Text the single keyword command STOP to Outland or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Outland Adventure Vehicle Rentals mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.
The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.
To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.

15. Contact Information
15.1 Communication to you
Subject to provincial and federal law, in order to contact you more efficiently, you agree that we may at times contact you using autodialed or prerecorded message calls or text messages at your phone number(s). We may place such calls or texts primarily to confirm or provide notices regarding your booking, investigate or prevent fraud, collect a debt owed to us, or communicate urgent messages. We may share your phone number(s) with service providers with whom we contract to assist us in pursuing these interests. We may share your phone number(s) and email with our affiliates for conducting their business or servicing us or you. We will not share your phone number(s) with unaffiliated third parties for their own purposes without your consent. Standard telephone minute and text and data charges may apply. Where Outland is required to obtain your consent for such communications, you may choose to revoke your consent.
You authorize Outland and its service providers, without further notice or warning and in our discretion, to monitor or record telephone conversations you or anyone acting on your behalf has with Outland or its agents for quality control and training purposes. You acknowledge and understand that your communications with Outdoorsy may be overheard, monitored, or recorded without further notice or warning. If you do not wish to have your call recorded, please contact us instead in writing through Outland support. Further, you expressly agree and authorize Outdoorsy to share recorded telephone conversations and related information with its insurance service providers for the purposes of claims review and adjudication.
